Scotland Mandates Environmental Impact Assessments for AI Data Centers Exceeding 50MW Capacity

On September 16, 2026, the Scottish Government enacted 'The Town and Country Planning (Environmental Impact Assessment) (Data Centres exceeding 50MW Power Capacity) (Scotland) Direction 2026'. Coming into force on September 17, 2026, the directive mandates comprehensive Environmental Impact Assessments (EIAs) for all proposed data center developments with a power capacity greater than 50MW. The mandate formally establishes statutory scrutiny over the environmental footprint of large-scale infrastructure, explicitly citing the rapid growth of AI workloads, intensified electrical grid demands, water extraction for closed-loop and evaporative cooling, and backup generator emissions.
